Spree is the first fitness monitor on the market to track body temperature, movement and heart rate without using a chest strap, and is the new “must have” workout companion for serious athletes.

The Spree Fitness app is designed to be used with the Spree SmartCap and Headband or any other device that supports Bluetooth Smart®. The app is also great as a stand-alone tool to track a variety of different workouts from the gym to the running trails and beyond.

Spree Fitness Application Software is Copyright 2012 – 2014. All rights reserved.

This software may not, in whole or in any part, be copied, reproduced, transmitted, translated (into any language, natural or computer), stored in a retrieval system, reduced to any electronic medium or machine readable format, or by any other form or means without the prior consent, in writing, from Spree Wearables, Inc.

Trademarks. Spree Wearables Inc, Spree Wearables logo, Spree, Spree App, Spree Fitness Application, Spree logo, and “On Your Mark” are Trademarks of Spree Wearables, Inc.

This End User License Agreement (EULA) is an agreement between you (the “User”) and Spree Wearables, Inc. and governs the use of software and related data (the “Software”). By installing the software, the User agrees to be bound by this EULA. In the event that the user does not agree to be bound by this EULA, then all instances of the software already installed must be uninstalled.

License. The Software is licensed and not sold to the User, and User has no ownership rights in the Software or related documentation. User is granted a limited, non-transferable license to use the Software on any iPhone, iPAD or iPod touch that the end-user owns or controls and as permitted by the Usage Rules set forth by Apple Inc. in the App Store Terms of Service. The Software may be used or copied only in accordance with the terms of this EULA. Spree Wearables, Inc. retains all ownership rights in the Software. User may not modify, copy, decompile, translate or disassemble the Software or allow it to be disassembled into its constituent source code.

Limitation of Liability/Disclaimer. USER EXPRESSELY ACKOWLEDGES AND AGREES THAT THE USE OF THE SOFTWARE IS AT HIS SOLE RISK. Spree Wearables, Inc. DOES NOT WARRANT THE SOFTWARE FOR A PARTICULAR USE, AND THE SOFTWARE IS PROVIDED “AS IS” WITH ALL FAULTS EITHER KNOWN OR UNKNOWN AND WITHOUT WARRANTY OF ANY KIND. IN NO EVENT WILL Spree Wearables, Inc. BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGE OR DAMAGES RESULTING FROM LOSS OF USE, OR FROM ANY DEFECT IN THE SOFTWARE, EVEN IF Spree Wearables, Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. Spree Wearables, Inc. Own Risk. User agrees and acknowledges that the Software has not been evaluated by or certified by the FCC or the FDA. The Software is not designed to provide any medical or diagnostic information. It is not a medical device. The GPS or mapping function in the Software must not be used for primary navigation. The Software must not be used in any safety or life application where the reliability, accuracy, and completeness of the Software and/or the associated data could in any way influence personal injury or death. The Software is not to be used or configured while driving or operating machinery of any kind, or while under the influence of alcohol, drugs or other substances that could impair User’s judgment.

Maintenance and Support. For Software support, User may contact http://support.spreesports.com or follow the Support link located in the App.

Use of Data. By using the Software, User agrees that Spree Wearables, Inc. may collect and use technical and usage data including information about your device, your use of the product and the Software, the operating system of your device and other such related information for the purpose of providing software updates, upgrades and other product improvements. User acknowledges and agrees that all such data shall be the property of Spree Wearables, Inc., for Spree Wearables, Inc.’s use without restrictions, except that such use shall in no way personally identify the User.

Term. User may terminate this EULA at anytime by destroying all copies of the Software and related documentation. EULA will also terminate automatically if User fails to comply with any term or condition in this EULA.

Other Terms Required by Apple Inc.

Responsibility. Spree Wearables, Inc. is solely responsible for the Software and Apple has no responsibility whatsoever to furnish any maintenance and support of the Software. In the event of any failure of the Software to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price (if any) for the Software to that User; and that, to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Software, and Apple specifically disclaims any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty.

Intellectual Property Rights. Spree Wearables, Inc. and the User acknowledge that, in the event of any third party claim that the Software or the User’s possession and use of the Software infringes a third party’s intellectual property rights, Spree Wearables, Inc., not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Maintenance and Support. Apple is not responsible for maintenance and support of the Software. User may contact support by going to http://support.spreesports.com.

Third Party Beneficiary. User acknowledges and agrees that Apple Inc., and Apple’s subsidiaries, are third party beneficiaries of this EULA, and Apple will have the right (and will be deemed to have accepted the right) to enforce the EULA against the User as a third party beneficiary thereof.

Legal Compliance. User represents and warrants that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.

Jurisdiction. This EULA as well as any dispute or claim relating to it shall in all respects be governed by and construed according to the laws of the State of Texas, excluding this state’s or any other jurisdiction’s conflict of laws principles. In the event User and Spree Wearables, Inc. are located in countries, which are parties to the 1980 United Nations Convention on the International Sale of Goods (“UNCISG”), the parties hereby agree that the EULA and any dispute or controversy relating thereto shall not be governed by the provisions of the UNCISG.

Recommendation/Suggestions. Any suggestions, recommendations, feedback or ideas submitted to Spree Wearables (the “Submissions”) in any manner become the property of Spree Wearables without compensation to the User. Spree Wearables is not obligated to respond to or even review any Submissions, not is it bound to keep such Submissions confidential, and may distribute them in any way it deems appropriate. Nevertheless, Spree Wearables, Inc. welcomes product feedback and such feedback can provided through the “Feedback” link in the Software or through www.spresports.com/contact. This is information that we may use in order to better serve you, to enhance your experience using our products.  Such information may include ZIP code, email addresses, images, sex, age, device identifier, fitness level, degree of Software usage, IP address, browser type and language, referring web-sites, information related to cookies, the type of system your device is using, as well as information relating to previous purchases and downloads from us.

Support Information

This information may be used when providing you with customer support and may include Device operating system and version, other installed applications, Spree hardware/firmware versions, Spree App versions, Software usage, IP address, browser type and language, referring web-sites, information related to cookies and related information.

Usage Information

This information may be generally collected through your usage of the Spree Headband and the Spree App and may include location, software usage statistics, results, activity performance details, and social media interaction.

What do we do with it

We will use the information to set up an account, provide you with service and support and collect information that helps us improve our products by analyzing trends in our customers, their demographics and their use of our products.

We will send you information about updates available to the Software or new products as well as any administrative messages related to product orders, support issues or other related activities.

What we share

We may share information with third party service providers such as credit card processing companies, shipping companies or other parties needed to fulfill orders or otherwise allow us to meet our obligations to you.  We may also share information with companies to assist in fraud investigations and we will provide information based on court orders, government requests or where required by law.

Public Sharing

By default, you give us the right to share any and all information, except the Personal Identification Information defined above.  Such information will not be shared and is protected through a variety of procedural and technical processes.  However, Spree Wearables, Inc. cannot guarantee that such information will be secure under all circumstances.
